Medical Malpractice
Medical malpractice claims handled by the firm are as a result of the negligence
of a licensed doctor, nurse, health care professional, clinic
or hospital's breach of the recognized standard of care. These
claims can involve operating on the wrong body part, not performing
an operation with proper skill and training, having unexpected
and unintended results from treatment, not providing proper
care and/or follow up care, mis-prescribing medication, etc.
An evolving area that may also involve a medical malpractice
claim, or may only involve an ordinary negligence claim, is
that of nursing home liability. The Michigan appellate
courts have not settled on whether claims for lack of proper
care, supervision and/or facilities in a nursing home setting
that leads to injury or death sounds in ordinary negligence
or requires professional standard of care testimony. If the
former, the proofs are simpler and less expensive. If the
latter, the proofs are much more stringent and costly and
there are "caps" on any recovery. We have handled
